A Non Government organization, Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit asking the Federal High Court in Lagos to “stop the Senate President Bukola Saraki from paying former Plateau State governor, Senator Joshua Dariye N14.2 million monthly allowances while he serves out a 10-year prison sentence for corruption because such payment violates Nigerian law and international obligations.”

According to SERAP’s lawsuit, Mr Dariye is still receiving the N750,000 salary and N13.5 million monthly allowances from the Nigeran Senate six months after his conviction. In June, an FCT high court convicted Dariye for diverting N1.162 billion state ecological funds while he was governor. He was sentenced to 14 years in prison, which was later reduced to 10 years by a court of appeal in Abuja. Dariye is said to have been paid N85.5 million as allowances since his conviction.

Joined as Defendants in the suit are: Mr Dariye and the National Assembly Service Commission.

In the suit number FHC/L/CS/2146/18 filed last Friday, SERAP argued: “Mr Saraki and the National Assembly Service Commission are trying to override Nigerian law and the judgment of our court by continuing to pay Mr Dariye’s allowances while he serves out a 10-year prison term and unable to sit and perform the functions of a senator. This action undermines the rule of law and is a great moral failure because it sends a message that corruption pays—it’s the opposite of Nigerian Constitutional principles and international obligations.”

The organisation also argued: “Stopping the Defendants would ensure that only sitting and serving senators are worthy of drawing salaries and allowances from the public treasury. It would also further the public interest and general public confidence in the government it elects. The interest in public confidence is greater than the convicted person’s interest in continuing to receive allowances while serving his sentence for corruption in Kuje prison.”

The 15-page lawsuit read in part: “Mr Saraki and the National Assembly Service Commission should be immediately restrained from unlawfully paying salaries and allowances to Mr Dariye who is serving jail term. Restraining them would send a clear message to Nigerian elected officials that corruption does not pay and contribute to promoting accountability and fostering public trust and confidence in Nigeria’s democracy, the rule of law and the governance system.”

“By paying Mr Dariye’s allowances while in prison, Mr Saraki and the National Assembly Service Commission have destroyed the efficacy and purpose of Mr Dariye’s conviction and have brought the rule of law and administration of justice into disrepute. SERAP and the public are alarmed by the action of Mr Saraki and the National Assembly Service Commission and they ought to be restrained by this Honourable Court.”

“Mr Saraki and the National Assembly Service Commission should not be allowed to continue to make a mockery of the rule of law, our process of administration of justice and our judicial system by behaving as if the Nigerian Senate is not bound by the court judgment which convicted and sentenced Dariye for corruption. Mr Saraki and the Nigerian Senate should be compelled to respect and obey decisions of the court.”

“By continuing to pay Mr Dariye’s allowances after his conviction and while in Kuje prison and unable to sit and perform the functions of a sitting senator, Mr Saraki and the National Assembly Service Commission have played a negative role to wit: undermining the authority and integrity of the court. Mr Saraki and the National Assembly Service Commission knew or ought to know that Mr Dariye has been convicted and sentenced and now serving his jail term in Kuje."

Meanwhile, no date has been fixed for the hearing of the case.

The Police Headquarters in Abuja has invited Senate President, Dr. Bukola Saraki, Senator Dino Melaye and Senator Ben Bruce to report at the Force Headquarters on Monday to answer to questions bothering on disturbance of public peace with their protest on Friday. The Police headquarters alleged that the Senators who were captured on camera, were involved in the disturbance of public peace and public safety, unlawful blockade of Shehu Shagari way for several hours preventing motorists, road users and other members of the public from having access and passage on the highway thereby disturbing public peace and public safety and causing innocent people to scamper for safety. The Force headquarters said the Senators are also being invited for ```“violent attack on Policemen posted to ensure security of the Force Headquarters, pushing and hitting the Policemen to forcefully enter the Force Headquarters to cause damage to Police equipment and Government properties.''`

   A statement signed by Force PRO, Acting DCP Jimoh Moshood said they are ```“hereby invited to report themselves to the IGP Monitoring Unit at the Force Headquarters on Monday, 8th October, 2018 for investigation”.``` 

The statement reads: ``“Today at about 1.30pm, unruly and violent protesters who are members of the Peoples Democratic Party (PDP) in their hundreds with thugs and miscreants inside several trucks and vehicles blocked the Shehu Shagari way in front of the Nigeria Police Force, Headquarters creating a gridlock of traffic on the highway and preventing motorists, road users and other members of the publicfrom having access and passage on Shehu Shagari way thereby disturbing public peaceand public safety and causing innocent people to scamper for safety. Suddenly the unruly/violent protesters surge and rushed violently on the Policemen posted to ensure safety of the Force Headquarters premises, pushing and hitting the Policemen to forcefully enter the Force Headquarters to cause damage to Police equipment and Government properties. The Police team, headed by a very Senior Police Officer despite the provocation, after issuing words of proclamation, warning these unruly PDP protesters who were chanting war songs of ”we no go gree o, weno go gree, we no go gree”, charged the Police personnel who used minimum force and dispersed them. Senator Dino Melaye, Senator Ben Murray-Bruce and others yet to be identified were recorded on camera pushing Policemen to forcefully enter the Force Headquarters to damage and destroy Police equipment and Government properties, while Senator Bukola Saraki was at the scene of the attack in his car also captured on camera along with hundreds of miscreants and thugs in the acts of disturbance of public peace and public safety, unlawful blockade of Shehu Shagari way for several hours preventing motorists, road users and other members of the public from having access and passage on the highway thereby disturbing public peace and public safety and causing innocent people to scamper for safety. The Inspector General of Police has directed immediate investigation into this unprovoked and unwarranted attack on the personnel of the Nigeria Police Force and the Force Headquarters premises which is against the law and condemnable. The Force will do everything within the law to bring all perpetrators of this crime to justice, no matter how highly placed. Consequently, Senator Bukola Saraki, Senator Dino Melaye and Senator Ben Bruce who were captured on camera to have been involved in the disturbance of public peace and public safety, unlawful blockade of Shehu Shagari way for several hours preventing motorists, road users and other members of the public from having access and passage on the highway thereby disturbing public peace and public safety and causing innocent people to scamper for safety and violent attack on Policemen posted to ensure security of the Force Headquarters, pushing and hitting the Policemen to forcefully enter .....".

Prof Itse Sagay(SAN), the Presidential Advisory Committee Against Corruption(PACAC) Chairman has joined other people like Oshiomole, APC Senators et al, who are calling on Senate President Bukola Saraki to vacate his seat honorably for the sake of morality.

The ace Prof of Law said this on Thursday when he was being interviewed by newsmen. The senior advocate said having a member of the minority party as the President of the Senate was an aberration anywhere in the world. He, therefore, asked Saraki to give up the seat and then re-contest the position next year if he wins on the platform of the Peoples Democratic Party.

The PACAC chairman said, “Saraki’s refusal to step down is a moral issue. The constitution does not specify that the Senate President must be a member of the majority party. All it states is that the majority of those sitting at the Senate will elect a Senate President." He added, “But by convention, there is no party that is in the majority that will allow a member of the minority party to lead. Now that he has crossed over to the PDP, he is morally bound to step aside and then re-contest as a PDP candidate. I am advising him to step down. Morally, he has no right to be there and if he is a man of honour and integrity, who has self-respect, he should not remain in office.”

However, when ask about the Minister of Finance NYSC exemption certificate allegation, the Professor of Law goofed totally by saying "no government can sack a competent person like Adeosun because of irrelevant issue like NYSC ...". And this has been generating condemnation from people across the country that a professor in criminal law can make such statement.

The Nigeria police force has initially invited the senate president, Bukola Saraki on Monday to give a statement, after they claimed that the arrested members of the dozen robbers claimed they are sponsored by the senate president and the Governor of Kwara stare.
