A Federal High Court in Abuja dismissed a lawsuit filed by Phillip Shaibu, the impeached Deputy Governor of Edo, challenging the legitimacy of the Peoples Democratic Party (PDP) governorship primary held on February 22.



The primary had resulted in the selection of Asue Ighodalo as the party's candidate.


Justice James Omotosho, delivering the judgment, stated that Shaibu lacked the locus standi, or legal standing, to contest the primary's outcome. The judge noted that Shaibu did not fully participate in the primary process and was not present at the venue on the day it took place.


Additionally, Justice Omotosho ruled that Shaibu's lawsuit was premature. According to PDP's internal regulations, members are required to utilize the party’s internal dispute resolution mechanisms before approaching the court. Shaibu had not followed this procedure, which includes first bringing grievances to the party’s appeals committee.


The judge also affirmed that there was ample evidence demonstrating that Asue Ighodalo legitimately won the primary.
