Barely a few days after a court gave an injunction that the 26 pro-Wike lawmakers should not be recognized, a Rivers State High Court in Port Harcourt has confirmed that Martin Amaewhule and 26 other members of the Rivers State House of Assembly are still members of the People’s Democratic Party (PDP).
On Monday, Justice Okogbule Gbasam delivered the judgment, stating that the claimants failed to prove that Amaewhule and the other lawmakers had defected to the All Progressives Congress (APC).
Justice Gbasam emphasized that party membership can only be proven through inclusion in the party's register or by possession of a membership card. He added that televised ceremonies or verbal statements are insufficient to establish membership.
The PDP had filed a motion to join the case and was included as the fourth defendant. Justice Gbasam ruled that the Rivers state government is obligated to obey all laws passed by the Assembly, as the lawmakers remain members of the PDP and are listed in the party’s membership register.
