Yesterday, Wednesday 10th July, the Peoples Democratic Party (PDP) approached the Court of Appeal in Abuja to contest a Federal High Court decision that nullified its February 22 governorship primary in Edo State, which had selected Asue Igbodalo as the party’s candidate for the upcoming September 21 election.
The PDP’s appeal is based on 25 grounds, requesting the appellate court to overturn the lower court’s judgment delivered on July 4, 2024. The initial ruling by Justice Inyang Ekwo declared the PDP primary invalid, citing non-compliance with the party’s constitution and electoral guidelines, specifically the exclusion of 378 elected ward delegates from the process.
Justice Ekwo emphasized that such exclusion violated Article 50(3) of the party’s constitution and stated that political parties must adhere to their own rules and the Electoral Act 2022. He ruled that the decision to exclude the ward delegates was arbitrarily wrong, as ward congresses must be conducted according to the law and cannot be canceled outside the provisions outlined in the Electoral Act and the party’s guidelines.
The court ordered the PDP to comply with the results of the ward congress held on February 4, 2024, which elected the excluded delegates, allowing them to participate in the primary election on February 22, 2024. Furthermore, the court issued a mandatory injunction preventing the PDP from excluding the delegates from any future primary elections.
In its appeal dated July 9, marked CA/ABJ/CV/2024, and filed by their lawyer Adeyemi Ajibade (SAN), the PDP argued that the trial court's decision was not supported by the evidence presented.
