Supreme Court Nullifies David Lyon Election, Order INEC To Give PDP Certificate In Bayelsa state

Barring any hindrances, the Governor elect in Bayelsa state Mr David Lyon would have become the substantial governor of the oil producing state due to his landmark victory in the last gubernatorial election in the state.

However, earlier today, the highest court in the country; the supreme court has nullified the election and instructed INEC to declare the second highest party in the election of which it is People Democratic Party (PDP) has the winner.

The apex court with the five panel that was presided by Justice Peter Mary Odili nullified Lyon's election sue to the circumstances that surrounded his deputy Senator Biobarakuma Devi, the deputy was alleged to have tendered false information to INEC in the November 16 election in the state.

With this judgement, the PDP candidate, Diri Duoye will now be the one to be inaugurated as Governor of the state.

The Peoples Democratic Party (PDP) has rejected in its entirety the results of the Saturday governorship election in Ekiti State. The national publicity secretary of the PDP, Mr. Kola Ologbondiyan said in a statement, alleging that the results were concocted by the All Progressives Congress (APC), the Independent National Electoral Commission (INEC) and security agencies. He said, “The process, characterized by open alteration of results, brutalization of innocent citizens, barefaced cruelty and intimidation of our members by security agencies, is a brazen assault against democracy and a direct subversion of the will of the people which is completely unacceptable.” Ologbondiyan stated that the PDP is armed with the details of all manipulations by the APC, who is being aided by security agencies and compromised INEC officials to rig the election, particularly, the audacious alteration and substitution of election results in favour of the APC at the collation centers amidst the brutalization of our agents.

The PDP also has details of all the polling units where we won, mostly with very wide margin ahead of the APC, only for the security agencies to aid the swapping and alteration of such results with those smuggled in by the APC at the collation centers. It is instructive to state that all the issues we raised ahead of the election, including the conspiracy between the APC, some compromised INEC officials and security agencies; the importation of thugs from other states by the APC;

the use of brutal force against our members and the alteration of results in favour of the APC, have all manifested. The PDP holds strongly that there is no way our democracy can survive with an electoral process such as this, being witnessed today in Ekiti state under President Muhammadu Buhari and the current INEC.

This bald-faced subversion of the will of the people is a clear recipe for a serious crisis and we invite Nigerians and the international community to hold President Buhari and his APC as well as the INEC Chairman and heads of security agencies in Nigeria responsible for any breakdown of law and order in Ekiti state as a result of this election.

This on-going robbery of the franchise of Ekiti people is a horrible rape of our democracy and most uncharitable of President Muhammadu Buhari .

After weeks of loggerhead between the Independent National Electoral Commission (INEC) and the All Progressives Congress (APC) on the status of APC in the forthcoming election in the state. And the final decision of INEC to excluded APC from participating in Senatorial, Gubernatorial, House of Representative and House of Assembly election in the state.

This decision by INEC led to a serious jubilations within the opposition parties in Zamfara state as INEC, yesterday disqualified all the candidates of the All Progressives Congress, APC, in the state from contesting the 2019 general elections in the state.

According to the governorship candidate of the PDP in the state, Dr Bello Mohammed Matawalle, the official release from the commission which excluded the state wing of APC from contesting the elections was a very transparent development.

 

According to him, INEC has proved to Nigerians that the 2019 general elections would be free, fair, credible and acceptable.

 

According to him, INEC has obeyed the judiciary, noting that the Federal High court’s judgment supersedes a state High court, appealing to the commission to ensure that Justice prevails in the 2019 general elections.

 

In another reaction, the governorship candidate of the All Progressive Grand Alliance, APGA, Alhaji Sani Abdullahi Shinkafi noted that he was waiting for APC in the state to flag off its campaign before going to the appeal court, noting that the INEC has done what was expected of the commission to do.

 

The presidential candidate of Nigerian Elements Progressive Party (NEPP) Comrade Ishaka Paul Ofemile said he appreciated the decision of INEC.

 

He noted that Nigeria is so big for anybody to use federal might or power of incumbency to manipulate the decision of over one hundred and fifty million citizens.

 

On his own part, Senator Garba Kabiru Marafa representing Zamfara central senatorial zone in the Senate pointed out that Governor Abdulaziz Yari wanted to prove to the world that he was the alpha and omega in the State.

 

The senator noted that Abdulaziz Yari came to the political limelight from nowhere through the political influence of senator Ahmad Sani Yarima.

 

Senator Marafa noted that even though he was not going to contest the governorship election, he was satisfied that Governor Abdulaziz Yari did not achieve his selfish interest after all.

 

Meanwhile, all the APC candidates and their supporters have remained silent, waiting for the Governor to enter the state Government House and make a public statement.

 

It could be recalled that the faction of the governor within the party had conducted the party primary elections in the state which the G8 group, the national headquarters of APC and INEC rejected.

 

The rejection of the primaries forced the camp of the governor to proceed to court against both the national headquarters of the party and INEC, praying the court to uphold the primaries.

 

However, the state court 3 sitting in Gusau, the state capital upheld the primaries while the Federal High Court Abuja declared the elections non-acceptable, thereby, upholding the decision of the INEC not to allow the APC candidates in the state to contest the general elections.

 

It was not yet known what would be the next line of action by the state chapter of the party even though our correspondent gathered that President Muhammadu Buhari is now set for his presidential campaign in the state.

As the leading opposition party Peoples Democratic Party (PDP) scheduled today for her national convention where the presidential flag bearer of the party will be chosen, the Chairman of the National Convention Planning Committee, Senator Dr Ifeanyi Okowa, expressed joy that everything has been put in place for a credible process to be delivered.

Addressing Journalists at the Adokiye Amasiemeka Stadium, Port Harcourt, Rivers State (chosen venue for the Convention) on Friday, Senator Okowa, who is also the Governor of Delta State, observed that members of the main organising committee and those of sub-committees have been working round the clock to ensure that no stone was left unturned for a credible and acceptable process to be delivered. 

According to him, “You can see that everything is right on course; the stadium is beautifully decorated and we are set for today (Saturday, 06/10/18).” 

“Accreditation of Delegates is a very sensitive issue, so, we are starting the accreditation process at 7 am,” the governor said.

Fielding questions from journalists about withdrawal of aspirants from the race, the governor said: “There is a process for aspirants to withdraw from the race, none of them has stepped down, we have 12 aspirants for now.

“We are expecting a very good convention, we are working very hard to deliver a process that is credible, free, fair and acceptable.

“As you can see, I and my colleagues in the committee have been round the venue, ensuring that all that is needed for us to have a smooth sail is put in place; we have also made the stadium our secretariat that is why we held in one of the Executive Lounge here at the stadium to deliberate on sundry issues that have to do with the entire convention.”
