Under the auspices of the Gaskiya Youth Movement, several members of the All Progressives Congress have petitioned the Federal High Court in Abuja to exclude Bola Ahmed Tinubu from running in the party's presidential primary in 2023.

Tinubu, a former governor of Lagos State, is one of the ruling party's presidential candidates and will compete in the party's presidential primary on Monday and Tuesday, June 6th and 7th.

The members made the request in a lawsuit filed with the court with the file number FHC/ABJ/CS/774/2022.

The lawsuit names Tinubu and his political party as the first and second defendants, respectively, and the Independent National Electoral Commission (INEC) as the third defendant.

They want the court to decide whether the ruling party's national leader, who has a "questionable educational background and date of birth," can participate in the ruling party's primaries or those of any other political party.

They further urged the court to declare that, based on the applicable statutes, the former Lagos State Governor is not permitted to participate in or fight the primary election on the first defendant's platform (APC).

The Abuja court was also urged to declare that the APC "can not authorize and/or permit his participation in the primary election for the office of the president" due to the presidential contenders' questionable educational background and date of birth, among other difficulties.

The group also wants the court to declare that Tinubu “cannot participate by presenting himself in any primary elections with any political party in Nigeria to be nominated as a presidential aspirant for the 2023 general election.”
