The All Progressives Congress (APC) has taken legal action against the former Governor of Osun State, Ogbeni Rauf Aregbesola, filing a case before a Federal High Court in Osogbo.
The party accuses Aregbesola of causing a faction within the APC by allegedly leading suspended party members to launch a political group named Omoluabi Progressives within the party.
In the suit, filed with number FHC/OS/CS/1/2024 at the Federal High Court, Osogbo judiciary Division, the APC, represented by counsel Ayodele Kusamotu, Yemi Akingbade, R.I.O Oloyede, and B.J Nwayen, is seeking a declaration from the court stating that Aregbesola cannot validly lead suspended party members and others to establish a factional group within the APC.
The party contends that the act of launching a factional political group using the party's logo, symbol, and slogan violates the constitution of Nigeria and the APC's constitution. The APC argues that Aregbesola lacks the constitutional authority to create a faction within the party, and as such, they are seeking a court order to proscribe and prohibit the factional group within the APC in Osun.
Additionally, the APC is requesting the court to restrain Aregbesola and his supporters from forming any further factional groups or parallel associations within the party. The lawsuit names the former Governor Rauf Aregbesola and three others, including the Independent National Electoral Commission, Hon Rasheed Olalekan Afolabi, and Mr Lani Baderinwa.
The relief sought by the plaintiff includes a declaration that the second defendant (Aregbesola) cannot validly lead suspended members or any other person to form a parallel political association within the party, using the party's logo, symbol, and slogan without proper registration with the Independent National Electoral Commission. The APC argues that such actions violate the provisions of the 1999 constitution (as amended) and the Electoral Act 2022.
This legal move highlights the internal challenges within the APC, with the party seeking legal recourse to address the alleged factional activities led by the former Osun State Governor. The outcome of this lawsuit could have significant implications for the party's internal dynamics and political landscape in Osun State.
