On Thursday, July 4, the Lagos High Court in Ikeja sentenced commercial bus driver Elijah Shokoya to 12 years in prison for killing Olawale Akinmade, an officer of the Lagos State Traffic Management Agency (LASTMA).



 


Justice Oyindamola Ogala delivered the verdict, concluding that the Lagos State Government had proven beyond reasonable doubt the charge of manslaughter against Shokoya. The incident, which led to Akinmade’s death, occurred on January 27, 2012.


"The prosecution has established beyond reasonable doubt that the deceased died, that the unlawful acts of the defendant caused the death of the deceased and that the acts of the defendant which eventually caused the death of the deceased were with the knowledge that injury or grievous bodily harm was the probable consequence," stated Justice Ogala.


The Lagos State Government charged Shokoya with manslaughter after he knocked down Akinmade with a blue and black Opel space bus, with the number plate AAA 74, while the officer was controlling traffic. The collision occurred at Demurin Street junction towards Mile 12 in Lagos, resulting in fatal injuries to Akinmade's head and body.


The prosecution argued that Shokoya's actions violated Section 224 of the Criminal Law of Lagos State, 2015, punishable under Section 229. Shokoya was arraigned on June 23, 2021, and pleaded not guilty to the charge.


Justice Ogala focused on whether the prosecution had sufficiently proven the charge of involuntary manslaughter. She concluded that the evidence presented was enough to secure Shokoya’s conviction.
