Earlier today, the Bayelsa Governorship Election Petition Tribunal, convening in Abuja, confirmed Governor Douye Diri's election victory.
The three-member panel, led by Justice Adekunle Adeleye, dismissed the petition filed by the All Progressives Congress (APC) and its candidate, Chief Timipre Sylva, citing a lack of merit.
In a unanimous decision, the tribunal concluded that the petitioners did not provide credible evidence to support their allegations against the election results. The panel declared all additional evidence and witness statements presented by the petitioners as incompetent.
Justice Adeleye emphasized that the law mandates election petitions to be filed within 21 days after the election results are declared, accompanied by written statements from all intended witnesses. The tribunal found that Sylva and the APC's decision to submit additional evidence and witness statements after filing the initial petition was an improper attempt to amend their case.
Furthermore, the tribunal dismissed the allegation that Deputy Governor Lawrence Ewhrudjakpo had submitted forged university degree and NYSC exemption certificates to the Independent National Electoral Commission (INEC) to qualify for the election. The panel ruled that this allegation was a pre-election matter, which should have been litigated before the Federal High Court. The tribunal noted that the petitioners missed the 14-day window to challenge the authenticity of the certificates after they were submitted to INEC, rendering the matter statute-barred.
