As team Naijacrawl have been updating you about the Imo governorship position legal battles from the Tribunal till the the Supreme court. Today, at the reviewing of the case that is presently going on,the Supreme Court has stood down for judgement in the application for review of the decision sacking former Governor of Imo State, Emeka Ihedioha and declaring Hope Uzodinma winner of the March 9, 2019 election in Imo State.


The seven-member panel of justices presided by the chief justice of the federation, Justice Tanko Muhammad stood down the matter till 3:00pm for judgement after listening to arguments of lawyers. Earlier, counsel to PDP and Ihedioha, Kanu Agabi (SAN) asked the apex court to set aside the judgement of January 14 and uphold the judgement of the Court of Appeal which dismissed the petition by Uzodinma.


Meanwhile,counsel to Uzodinma, Damian Dodo (SAN) said the Supreme Court judgement actually set aside every decision of the Court of Appeal, which he described as a “Tsunami”.

He later stated that there was no ambiguity in the judgement of the Supreme Court which declared his client ( Uzodinma) winner.

The Chairman of the Imo State Independent Electoral Commission (ISIEC), Mr Ethelbert Ebebuchi has revealed on Sunday in Owerri that the All Progressives Congress (APC) has won all the 27 chairmanship seats in the just concluded local government elections in Imo State.

Mr Ebebuchi made the disclosure while announcing the results of the elections at the ISIEC Headquarters along Orlu Road in the state capital.

It will be recalled that the election conducted yesterday will be the first to be conducted by the electoral body in the state in the last seven years.

Meanwhile,  the People Democratic Party (PDP) did not participate in the election yesterday and citing that the supreme court has "Advice" that there should be status quo and also, the All Progressive Grand Alliance (APGA) did not participate in the election too. The election was between APC and other 13 political parties.

Senator Ademola Adeleke of the Peoples Democratic Party in the September 22 governorship election in Osun state has been declared winner of the election by the tribunal.

 

The Osun State Governorship Election Petition Tribunal sitting in Abuja has declared Ademola Adeleke as winner of the September 2018 election in the state.

The 3-man tribunal upheld the the petitions filed by the candidate of the Peoples Democratic Party (PDP), Ademola Adeleke and the PDP, challenging the victory of the All Progressives Congress (APC) and Governor Gboyega Oyetola at the September 2018 governorship election.

The tribunal had earlier dismissed the objections of the APC and Oyetola. It said Adeleke’s petition has merit. The tribunal also declared the rerun election as illegal.

NAN reports that the PDP and Adeleke, had filed a petition asking the tribunal to declare that he polled the highest lawful votes and should be declared the winner.

But Oyetola, APC and INEC had filed their notices of preliminary objection contending among others that the petition was incompetent and that the court lacked jurisdiction.

A three -member panel of the tribunal , dismissed the objections filed by Gov. Oyetola, APC and the Independent National Electoral Commission (INEC).

Both Adeleke and the PDP in their different petitions had urged the tribunal to declare that he scored the highest lawful votes in the election and should be declared as winner.

However, Oyetola, APC and INEC filed their notices of preliminary objection against the petition on the grounds that the petition is incompetent adding that the court lacked jurisdiction to entertain the petition.

Delivering the‎ lead ruling of the three-man tribunal, Chairman Ibrahim Sirajo, held that the objections were misconceived and struck them out.

The Tribunal held that the CTC should and must be an exact replica of the EC8A pink copies.

The discrepancies must therefore be explained and justified by INEC.

In this instance, the tribunal held, INEC failed to explain nor justify the alterations and that they failed to call any witness to justify the alterations.

The tribunal held that the attempt to explain the alterations on the basis of mere corrections of errors is not acceptable and the fact that the said errors were consistently made in the disputed areas means it was a deliberate action taken.

However, it is expected that APC will file an appeal within the stipulated time.

The problem with the flag bearer of the People Democratic Party in the forthcoming election in Osun state is yet to be resolved as  an Abuja court instructed  WAEC to produce ledger of Senator Ademola Adeleke's result.

   Adeleke is PDP governorship candidate for September 22 election in Osun state.

   The court also mandated WAEC to either confirm or deny Adeleke's result which he sat for in 1981.

   A Federal High Court sitting in Abuja has given an order mandating the West African Examination Council (WAEC), through its director general or any other designated officer of the council to depose to an affidavit over controversy surrounding O'level result of Senator Ademola Adeleke.

   Reports has it that the court asked WAEC to either confirm or deny that Adeleke who is the flagbearer of the Peoples Democratic Party (PDP) in the forthcoming gubernatorial election in Osun state, with candidate number 19645/149, sat for the Senior Secondary School Certificate Examination (SSCE) conducted by the council at Ede Muslim High School, Osun state in May/June 1981, within five days of being served the order.

   Though, it was gathered that the court also gave an order compelling WAEC through any of its any designated officers, to produce the ledger containing the results of all candidates that sat for the Senior Secondary School Certificate Examination conducted by the council at Ede Muslim High School, Osun state in May/June 1981, within five days of being served the order. The court gave the order while ruling on an application filed by the duo of Wahab Adekunle Raheem and Adam Omosalewa Habeeb against Senator Ademola Nurudeen Adeleke and two others.

   It was gathered that those joined as defendants in the suit are the Peoples Democratic Party (PDP) and the Independent National Electoral Commission (INEC). The court further ordered WAEC to serve on all parties in the suit, the copies of the filed affidavit and ledger within five working days of filing same before the court. The court also made an order abridging the time within which the defendants may enter an appearance and file processes to five days from the day of the service of the originating summons and also granted leave to the defendants to serve Senator Adeleke all originating summons and subsequent processes in the suit by substituted means by serving them on any officer or clerk at the office of the clerk of the Senate of the federal republic of Nigeria.

   The court, however, refused to grant the order of Interim injunction restraining INEC from recognizing Senator Adeleke as PDP’s candidate for the September 22 election in Osun state pending the hearing of the motion or retraining him from parading himself as the PDP candidate in the forthcoming election.
