Senior Advocate of Nigeria (SAN) Olu Daramola, a partner at the prestigious Afe Babalola law chambers, has filed a N500 million defamation lawsuit against Tomilola Titus Farotimi, popularly known as Dele Farotimi, over claims of defamatory content in his book titled Nigeria and Its Criminal Justice System.
The suit, filed at the Ojodu Abiodun Division of the Ogun State High Court, follows a similar legal action initiated by Chief Afe Babalola (SAN) against Farotimi for alleged libelous statements in the same book.
According to the writ dated December 13, 2024, and filed by Daramola’s legal representative, Iheanyichukwu C. Uwa, the claimant alleges that specific content on page 64 of the book is defamatory. Daramola claims that the statements have subjected him to ridicule, disrespect, and disrepute among the public, undermining his reputation as a competent, diligent, and trustworthy legal practitioner.
Key Demands in the Lawsuit
Daramola is seeking the following from the court:
- Damages: A N500 million award for exemplary and general damages caused by the alleged defamatory statements in the book.
- Public Apology: A court order compelling Farotimi to publish an unreserved apology in The Guardian and The Punch newspapers, or any other two widely read national dailies.
- Book Removal and Destruction: A directive to recover and destroy all copies of the book in circulation, both in print and digital formats, from bookstores, libraries, social media platforms, and online archives.
- Perpetual Injunction: An order restraining Farotimi, his agents, or representatives from further publishing or distributing the book in any format.
- Interest on Damages: A 10% annual interest on the judgment sum from the date of the judgment until the full settlement of the debt.
Daramola asserts that the book’s content has severely injured his character, prestige, and professional standing, necessitating these legal actions.
