The Lagos Court of Appeal has reasserted Peter Ndubuisi Mbah of the Peoples Democratic Party (PDP) as the duly elected Governor of Enugu State.
On March 22, INEC declared Mbah the winner with 160,895 votes, surpassing his closest rival, Chijioke Jonathan Edeoga of the Labour Party, who secured 157,552 votes in the Governorship poll held on March 18.
Expressing dissatisfaction with the declared results, the Labour Party and Edeoga, represented by their counsel Chief Adegboyega Awomolo SAN, approached the tribunal seeking redress. INEC, Mbah, and PDP were listed as the first, second, and third defendants, respectively.
Edeoga and the Labour Party based their petition on three grounds:
(1) Alleging that Mbah was not qualified to participate in the election due to the submission of a forged NYSC discharge certificate under oath.
In a comprehensive ruling, the Appeal Court upheld the tribunal's decisions entirely. The three-member panel ruled in favor of the Respondents, affirming the legitimacy of Peter Mbah as the duly elected candidate.
