It is another blow for Governor Godwin Obaseki after his anointed candidate lost out of the Saturday election a Federal High Court in Abuja, on Tuesday, reaffirmed the reinstatement of Rt.
Hon. Comrade Philip Shaibu is the Deputy Governor of Edo State. The court, led by Justice James Omotosho, dismissed an application for a stay of execution filed by the Edo State government, headed by Governor Godwin Obaseki, and the state House of Assembly, which sought to challenge Shaibu's reinstatement.
Justice Omotosho, dissatisfied with the arguments of the appellants, ruled that he could not grant their application, standing by his earlier decision. In addition to dismissing the appeal, the court imposed a fine of ₦200,000 each against the appellants.
Shaibu was initially reinstated by the court in July 2024, following his impeachment by the Edo State House of Assembly. The court had declared the impeachment illegal, unconstitutional, and void, citing violations of sections 188 and 35 of the 1999 Constitution (as amended).
The court also ordered that Shaibu's salaries and allowances, dating back to his impeachment in April, be paid in full. Furthermore, a perpetual injunction was issued, preventing Governor Obaseki and the state assembly from obstructing Shaibu from carrying out his duties as Deputy Governor.
